What changed

On 8 September 2026 the US President signed three proclamations under section 338 of the Tariff Act of 1930, covering alcoholic beverages, dairy and motor vehicles. They exclude listed products of Canada from import. The alcohol proclamation states that the listed beverages "are excluded from importation into the United States, effective with respect to goods imported on or after 12:01 a.m. eastern time on September 29, 2026." The products had faced a 50% additional duty since 22 August 2026, under Proclamations 11046, 11047 and 11048.

What CBP says

CBP's CSMS # 70050970 says covered products can no longer be admitted to a foreign trade zone or bonded warehouse, moved in-bond or entered for consumption. Entries containing them "will be unconditionally rejected". Covered goods fall under HTSUS headings 0404, 1702, 1703, 2202, 2203 to 2208 and 8711. Goods imported before the cut-off can still be entered, at the 50% duty.

The alcohol scope

For alcohol, the ban applies only where a product meets the scope limit in the Alcohol Annex. Lines marked "Packaged" cover only products in bottles, cans, boxes, kegs or similar direct-to-consumption containers. Alcohol outside those limits is not banned and stays subject to the 50% duty under Proclamation 11046.

What traders should do

  • Check each product's HTSUS line and scope limit against the annex to the relevant proclamation.
  • Do not ship covered goods. CBP rejects these entries.
